Passionategeekz According to June 19, today, the China TV Drama Production Industry Association (China Production Association) jointly held a media briefing with three major video platforms: Youku, Tencent Video and iQiyi, focusing on the issue of piracy governance in the film and television industry. This media conference held an in-depth exchange on the current situation of piracy in the industry, difficulties in protecting rights and governance ideas. And released several recent typical cases。
According to the four major platforms of iQiyou and Tencent, the national drama industry is caused by piracy and infringement every year.Loss up to 20 billion yuan. Su Xiao, vice president and secretary-general of the China Association for Systems, introduced that now “pirated version is broadcast” and “no one is spared” have become the norm in the industry. After any drama on a mainstream video platform is launched for a few minutes, there will be pirated channels spread everywhere. The serious impact of the current “stubborn disease” of piracy on the industry has reached a “life and death severity”.
Several recent typical cases were also released at the exchange meeting, and Passionategeekz compiled them as follows:
Case 1: Youku and iQiyi jointly sue short video infringement caseThe court paid 800,000 yuan in the first instance. This is the first case between the two major platforms as plaintiffs and is of landmark significance.
Case 2: “Crazy” short video platform infringement caseThe court found that a short video platform did not obtain the permission of iQiyi Company. By setting up topics, content sectors and other behaviors, it attracted user attention, causing a large amount of dissemination, and constituted an infringement of the information network dissemination rights. It finally ruled to compensate 30 million yuan. This is one of the cases with a high compensation amount in similar cases in China.
Case 3: Recently, popular dramas such as “The Legend of the Sea” and “Bending the Waist” are inevitably stolen.. A man built hundreds of pirated film and television websites on the Internet for the purpose of making profits, illegally collecting unauthorized film and television works, and accumulated illegal income of hundreds of thousands of yuan. He has been criminally detained.
Case 4: A short video platform infringes on “Qing Yu Nian”The second instance court held that the platform’s subjective infringement intention was obvious and the infringement was serious, and punitive compensation was applied. It was sentenced to compensation of 9.64 million yuan, which is a rare case of using punitive compensation.
Case 5: Tencent v. Anbo TV box infringement caseThe Federal Court of Texas West District, USA made a final judgment, awarding $84.75 million (about RMB 616 million), of which “Sauvignon Blanc” was awarded $11.7 million (about RMB 85.27 million), which is the highest compensation for domestic companies to protect their video rights overseas, and it also provides a strong reference for judgments in similar cases.
