This year, the Shanghai Cyberspace Administration of China and the Shanghai Market Supervision Administration and relevant industry authorities continued to carry out the “Bright Sword Pujiang 2025” special law enforcement action to protect personal information rights. The special action focused on eight key tasks in three major areas and “Resisting AI Abuse” is one of the governance priorities this year.
During the special operation, the Shanghai Cyberspace Administration of China found that some websites that provide generative artificial intelligence service functions did not carry out security assessments as required by the law, did not take necessary security measures to prevent the generation of illegal information, and did not take restrictive measures to prevent the abuse of generative artificial intelligence functions, resulting in the infringement of personal information rights and interests, the production of illegal and irregular content such as “opening boxes” and “money laundering”, and the generation of pornographic and vulgar pictures, which poses a great security risk. The Shanghai Cyberspace Administration of China urges enterprises to remove relevant functions on their own and can only be re-launched after passing the security assessment.
A recent “look back” inspection found that, without passing the security assessment and taking necessary safety protection measures, the three companies that were required to go offline re-launch the generative artificial intelligence functions with security risks on their own. The Shanghai Cyberspace Administration of China interviewed enterprises in accordance with the law, conducted serious criticism, demanded comprehensive rectification, and filed a case for investigation and punishment of the enterprises involved in accordance with the law. Typical issues are reported as follows.
Generate illegal information that infringes on the personal information rights of others.Individual enterprises have not prompted users to inform the edited individuals in accordance with the requirements of the “Personal Information Protection Law” and “Regulations on the In-depth Synthesis Management of Internet Information Services” and other laws and regulations, when editing other people’s biometric information, they should inform the edited individual in accordance with the law and obtain their separate consent. If a website clones its voiceprint information and performs voice synthesis for other users without obtaining the consent of the editor.
Generate illegal information that infringes on other people’s legitimate rights and interests such as reputation and privacy.Some companies have not taken necessary measures to prevent users from generating information that infringes on other people’s legitimate rights and interests such as reputation and privacy. If a website can generate false pictures containing public figures based on input information; a website can generate illegal content such as “opening a box tutorial”, “exposing other people’s privacy information” based on user requirements.
Generate illegal information prohibited by laws and regulations such as pornography and violence.Some enterprises have not taken measures such as stopping generation, dissemination, and elimination in accordance with the requirements of the “Cybersecurity Law” and “Interim Measures for the Management of Generative Artificial Intelligence Services” and other laws and regulations. If a website enters information, it can generate harmful pictures such as pornography and violence; a website can generate text information with obvious “sexual hints” based on needs.
A relevant person in charge of the Shanghai Cyberspace Administration of Information Technology pointed out that promoting the healthy development and standardized application of generative artificial intelligence should safeguard national security and social public interests, and protect the legitimate rights and interests of citizens, legal persons and other organizations. Generative artificial intelligence service providers shall assume the responsibility of producers of network information content in accordance with the law and fulfill network information security obligations. If personal information is involved, they shall assume the responsibility of processors of personal information and fulfill personal information protection obligations. In the next step, the Shanghai Cyberspace Administration of China will continue to carry out the “Bright Sword Pujiang 2025” special law enforcement action to protect personal information rights and interests, continue to crack down on “AI abuse”, focus on rectifying “AI disguise”, “AI face change and voice change”, “AI fraud”, and personalized push algorithm services that infringe on personal information rights and interests. Those who fail to correct their repeated teachings and have serious problems will be resolutely dealt with and punished.
